A technology known as backscatter x-ray vision makes it capable for seeing through clothes and walls had been rolling out on U.S. Streets. Currently used in courthouses and airport security, this is yet another example of the growing police state. American Science & Engineering, a company based in Billerica, Massachusetts, has sold U.S. and foreign government agencies more than 500 backscatter x-ray scanners mounted in vans that can be driven past neighboring vehicles to their contents said Joe Reiss a vice president of marketing at the company. The biggest buyer of AS&E’s machines over the last 7 years has been the Department of Defense for the war in Afghanistan and Iraq however law enforcement agencies have also deployed the vans, supposedly to search for vehicle-based bombs in the US. The Z Backscatter Vans, or ZBVs, as the company calls them, bounce a narrow stream of x-rays off and through nearby objects, and read which ones come back. Absorbed rays indicate dense material such as steel. Scattered rays indicate less-dense objects that can include explosives, drugs, or human bodies. That capability makes them powerful tools for security, law enforcement, and border control

Now Federal Reserve Chairman Ben Bernanke Wants To Eliminate Reserve Requirements Completely?

Up until now, the United States has operated under a "fractional reserve" banking system. Banks have always been required to keep a small fraction of the money deposited with them for a reserve, but were allowed to loan out the rest. But now it turns out that Federal Reserve Chairman Ben Bernanke wants to completely eliminate minimum reserve requirements, which he says "impose costs and distortions on the banking system". At least that is what a footnote to his testimony before the U.S. House of Representatives Committee on Financial Services on February 10th says. So is Bernanke actually proposing that banks should be allowed to have no reserves at all?

Harvard Professor Does American's a Disservice by Playing "Race Card"

When prominent African American Harvard professor, Henry Louis Gates Jr. was arrested in his own home after police responded to an alleged report of a break-in, cries of racial profiling could immediately be heard ringing from coast to coast. The Cambridge police department then scrambled to prove Sergeant James M. Crowley was no racist.

It’s no real surprise that even President Obama tried to make this about race saying “what I think we know separate and apart from this incident - is that there is a long history in this country of African-Americans and Latinos being stopped by law enforcement disproportionately, and that's just a fact." Either President Obama is incredibly naive or is purposefully redirecting the focus of this incident. This arrest of a man in his own home, even after providing proof he had a right to be there, had nothing to do with race at all. Henry Louis Gates was guilty of a far worse offense than being a black man in America. His crime? Challenging the authority of the police. Henry Louis Gates wasn’t arrested for breaking and entering, he wasn’t arrested for being black, he was arrested for disorderly conduct after “exhibiting loud and tumultuous behavior,” according to the police report.

Apparently, the professor was forced to break into his home at about one in the afternoon (broad daylight) when the lock on his front door had jammed. When police arrived, Gates was forced to provide identification while standing in his own home, something he was more than a little miffed about. In the report Officer Crowley filed, he wrote “"While I was led to believe that Gates was lawfully in the residence, I was quite surprised and confused with the behavior he exhibited toward me.” Really, you’re surprised that he was upset by the fact you’re harassing him in his own home for doing absolutely nothing wrong?

S. Allen Counter, a Harvard Medical School professor who spoke with Gates about the incident said “He and I both raised the question of if he had been a white professor, whether this kind of thing would have happened to him, that they arrested him without any corroborating evidence.” Yes, this is exactly as it would and does play out every day in this country to citizens of every color who decide to stand up for themselves. By calling this a crime of racial bias Professor Gates, President Obama, and the media fail to address the real injustice in this country, which is the ever increasing authoritarian use of force on innocent citizens. One needs only to look at the countless cases of tasering on the very young and very old simply to force them to comply. Most will remember Kathryn Winkfein the 72 year old great-grandmother who was tasered after arguing with a police officer, who was at least twice her size and half her age, over a traffic stop. The officer claimed he felt threatened. There are also cases of children as young as six being tasered. Clearly, the use of force is no longer confined to self-protection. The abuse of tasers by police needs serious investigation and reform.

However the underlying problem is the change of policy of our police departments from “to protect and serve” to one of “to oppress and enslave”. We as Americans must define what role police are to have in this society. Do they work for us or against us? We must decide and then hold them to that role. As law enforcement’s power to use force to make citizens comply increases, our liberty and security to be free from unwarranted intrusions and injuries decreases. If the role of the police is to keep us safe, who will keep us safe from them? I can only implore that when your civil liberties are infringed by law enforcement officers or others, do not lose sight of the real injustice, the slow decay of this once great beacon of freedom into a draconian police state where all are subject to the whims and threats of a badge welding minority.

Open Letter To Justin Williams

June of 2009, the Supreme Court of South Carolina ruled that Governor Mark Sanford can not refuse the Federal Stimulus money being giving to his state. Justin Williams, a third year law student was one of the plantiffs that brought this suit against Gov. Sanford. A June 10th article by Katie Jones from UWire and reported on Foxnews.com discusses the suit and references Justin Williams and what he has done. Dear Justin William,

Recently you made the news for your role in bringing a suite against the Governor of your state Mark Sanford for refusing to accept the "bailout" money from the Federal Government. While I admire your altruistic views I want to take this time to point out how your actions came with ramifications that quite frankly I would expect a third year law student to think through. My first conclusion is they do not teach law students about the constitution in South Carolina’s schools. My second conclusion is that some law students don’t take the time to read and understand the Constitution on their own. Had you read and studied this document, a document that is the basis of our country's Government you would have known that Gov. Sanford was doing the right thing and was only looking out for the best interest of South Carolina. You may wonder why someone like myself living in California cares about what you have done and why you have done it, I can only point out that what you have done affects all Americans, not just those living in South Carolina. How you managed to convince your Supreme Court to rule in favor of forcing the Governor to take this money is a quandary. What you and the Supreme Court told Gov. Sanford is that you have to participate in plundering the rest of the nation for your righteous cause. I do believe that those justices should hang their heads low and ultimately the citizens of your state should call for their removal. They failed at their job to uphold the Constitution as you have failed on your job as a citizen. Your actions and the decision of your state’s Supreme Court will ultimately hurt those very same people you think you are looking out for. Their cost of living will increase due to the inflation caused by all the printing of new money for these bailouts and their taxes will increase in order for the government to cover up this hidden tax. Thanks to your actions, the Federal Government will now have more power and permission to continue to plunder the citizens of your state and every other state in the union.

The powers delegated to Congress do not include the funding of state projects including education. I commend Gov. Mark Sanford for attempting to shake off the yoke of federal funding; funding which the federal government uses to bully States to their will. The powers of the State in regards to the lives of their citizens must not be infringed. Gov. Sanford’s actions in refusing stimulus money were in the State’s best interests and, by extension the rest of the nation. Only the residents of a particular state can fully understand the needs of that state. An all-encompassing central government was the last thing our founders wanted when they imagined a free and prosperous Republic. By subverting the Governors authority in this matter you have done your state a grave disservice. You have enabled the Federal Government to have an ever-increasing stranglehold on your state, given them just-cause in their ever increasing spending when many Americans are struggling just to get by. Where do you think this "stimulus" money comes from? It comes from the pockets of hard working Americans who will be taxed even further to keep up with this, illegal I might remind you, spending. So thank you Mr. Williams, thank you for stealing from me and every other tax-paying American just so you will not have to pay for your own education, as a responsible individual should. While you celebrate your imagined victory, just remember that when you finally graduate your earning power will be significantly decreased due to the mass inflation caused by the spending you championed.

I do not know all of Gov. Sanford’s policies but I do know he was right with his decision to refuse the money. He is the true hero. Not many Governors are willing to stand up against the unconstitutional powers of Federal Government has usurped. I would direct you to read both Article One, Section Eight of the Constitution as well as the Tenth Amendment. As you are a law student, the text of these items should be clear.

From this day forward I would suggest you work with-in your state and community to have your altruistic views enacted and leave the Federal Government out of it as the Constitution directs. I also suggest you draft letters of apology to your fellow citizens and to Gov. Sanford for your actions as they will, in the end, have the opposite effect on your state than you intended. The citizens of South Carolina should applaud Gov. Sanford and recognize that his decision was in the best interest of the state and its people. I personally want to thank Gov. Sanford for his courage in standing up to the Federal Government, for his understanding of his State’s rights and hope that he serves as an example to all the Governors of the other forty-nine states. Our Governor here in California is standing there like Oliver Twist saying, “Please sir can I have some more”. Your Governor is standing up saying “No More” -- a statement that makes him the real hero.

State rights and the Tenth Amendment

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

These are the words of the tenth amendment of the constitution of the United States. The U.S. constitution, which happens to be the shortest in history, was penned with the intent of limiting the powers of the federal government and preserving the individual liberties of the people. However, over the course of the last 222 years, the federal government has taken an ever increasing role in the lives of American citizens, far beyond what was intended by the framers of the constitution. Through perverse "interpretations", the powers that be have twisted the republic our forefathers envisioned into an all encompassing power leaning ever closer to despotism.

Our founding fathers sought to create a system of government that protected the liberty of individuals. Article one, section eight of the constitution, specifically deals with the powers granted to congress. They are, as our forefathers put it, "few and defined". The powers granted to congress deal with national issues which include: currency, the military, to lay and collect taxes. So how is it that Congress is passing legislation that deals with our personal lives, what we can or cannot put into our bodies, how we run our businesses, or who we can or cannot marry? These are personal, not national, issues. The question we must ask ourselves is how is Congress getting away with this?

Through the misinterpreted Interstate “Commerce Clause” and to a lesser extent the General Welfare Clause, Congress has forced their way into nearly every aspect of our lives. In Article one, section eight, the first line states "The Congress shall have Power To lay and collect Taxes, Duties,...pay the Debts and provide for the common Defense and general Welfare of the United States... “If you were to read on, the third line states "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes." Congress, in tandem with the Supreme Court, has used these two lines to overextend the power granted to them by the Constitution.

Overreaching and overspending are not a recent phenomenon. Even our founders struggled with the dilemma of spending to improve the nation while staying within the confines of the Constitution. Both Jefferson and Madison entertained the idea of building roads through federal sponsorship. However, being strict constructionists, they knew this authority was not delegated to the federal government and an amendment would have to be enacted in order to proceed. In 1817, Madison himself was presented with the Bonus Bill, a bill which would have allocated money to the Federal government for the construction of roads and canals. He vetoed it. Despite the fact that he was in support of the bill's goals on a personal level, he could not allow such a deviation from the original intent of both the Interstate Commerce clause and the General Welfare Clause to be permitted.
In his response to the bill he wrote, “ ‘The power to regulate commerce among the several States’ cannot include a power to construct roads and canals, and to improve the navigation of water courses in order to facilitate, promote, and secure such commerce without a latitude of construction departing from the ordinary import of the terms strengthened by the known inconveniences which doubtless led to the grant of this remedial power to Congress...To refer the power in question to the clause ‘to provide for common defense and general welfare’ would be contrary to the established and consistent rules of interpretation, as rendering the special and careful enumeration of powers which follow the clause nugatory and improper. Such a view of the Constitution would have the effect of giving to Congress a general power of legislation instead of the defined and limited one hitherto understood to belong to them, the terms ‘common defense and general welfare’ embracing every object and act within the purview of a legislative trust..."

Essentially what Madison is saying here is that the terms “Interstate Commerce” and “General Welfare” are only used to explain why Congress was delegated the powers enumerated by the constitution and are not to be interpreted as separate powers in addition to the aforementioned, and to do so would grant Congress unlimited powers well beyond what the framers intended.

Now it is not only common place, but the accepted norm, that it is the authority of Congress and position of government to oversee every aspect of life in the name of "general welfare". In the federalist papers James Madison writes "The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce; with which last the power of taxation will, for the most part, be connected. The powers reserved to the several States will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people, and the internal order, improvement, and prosperity of the State." Could the intent of our founders be any clearer?
While the ill conceived programs such as Social Security, Medi-care, bailouts, and educational funding may be well meaning, they are illegal. None of these fall under the powers delegated to Congress and no amendments have been made to grant this authority. Federal laws on gun licensing, substance control and industry regulation are illegal as well. These are matters which were meant to be left to the states. When it comes to reining in this overreaching, there have been few, if any, times that the Supreme Court has not sided with Congress. This puts the American public at great risk, as it is the Supreme Court’s role to interpret our Constitution. If we cannot count on them to adhere to the vision our Founding Fathers had, who can we turn to?

Finally states have had enough of this Illegal government interference. To date, thirty-five states have declared their sovereignty. While this is a great start, it is not nearly enough. States need to begin refusing federal aid for matters that are the states' or individual's responsibilities. Recently, South Carolina’s Governor, Mark Sanford, refused $700 million in stimulus money. A federal judge has ordered him to take the money stating that "He (the Governor) did not have the authority to refuse." This is because he stood alone in his fight to shake off the yoke of federal funding, but if every state stood in solidarity, refusing federal funds, and by extension federal intrusion, it would send a clear and undeniable message of enough is enough.
